Jury Awards $5,600,000.00 For Motor Vehicle Accident on Niagara Falls Boulevard.
The 47 year old plaintiff, who was a former insurance agent, sustained serious injuries in an automobile accident that occurred on Niagara Falls Boulevard. The plaintiff was traveling northbound when a southbound Federal Express Truck suddenly turned left in front of him. The Beltz firm successfully argued that the defendant driver should be held liable for the happening of the accident as a matter of law, and the case then proceeded to trial for a determination of which injuries were caused by this accident and the amount of the plaintiff's damages. The plaintiff had sustained prior back problems for which he had undergone a number of surgeries. The plaintiff sustained a broken nose, deviated septum, nerve damage and multiple injuries to his cervical and lumbar spine, which required surgery. The jury awarded $5.6 million, reduced by 5% comparative fault. The plaintiff made a post-trial motion, and at that juncture the defendant's insurance carrier agreed to settle the case for more than the judgment amount.
